End User License Agreement

LICENSE
Fusion Scripts grants you a non-exclusive license to use the Garage Module Software ("the Software") on one installation to be accessible by one URL (web address) subject to the provisions in all sections of this Agreement.

GRANTED RIGHTS
1. You may:

    a. Customize the Software's design and operation to suit the internal needs of your web site except to the extent not permitted in this Agreement.

    b. Copy and distribute the Software in unmodified form provided that the entire package, including - but not restricted to - copyright, license agreement, notices and disclaimers, as released by the initial developer of the Software, is distributed.

    c. Develop and distribute modifications to the Software, in a form that is separate from the Software, such as patches. The following restrictions apply to modifications:

        i. Modifications must not alter or remove any copyright notices in the Software.

        ii. When modifications to the Software are released under this license, a non-exclusive royalty-free right is granted to the initial developer of the Software to distribute your modification in future versions of the Software provided such versions remain available under these terms in addition to any other license(s) of the initial developer.

2. You may not:

    a. Reverse engineer, disassemble, or create derivative works based on the Software for distribution or usage outside your web site.

    b. Modify and/or remove any copyright notices or labels on the Software on each page (unless copyright output removal license is purchased) and in the header of each script source file.


DISCLAIMER OF WARRANTY
The Software is provided on an "AS IS" basis, without any expressed or implied warranties, including, but not limited to, warranties of infringement and the implied warranties of merchantability and fitness for a particular purpose. In no event shall Fusion Scripts be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the distribution or use of this software, even if advised of the possibility of such damage. Should the Software prove defective, you assume the entire cost of any service and repair.

TERMINATION
The license is effective until terminated. You may terminate it at any time by returning and/or destroying the Software together with all copies. This Agreement will terminate automatically upon failure to observe or perform any provisions of this Agreement and failing to remedy such breach within thirty (30) days after written notice thereof has been given.

Licensee must destroy all copies of the Software, including any updates or prior versions, upon termination of this Agreement.

PROPRIETARY LABELS
Authorization to remove or modify output of copyright notices can be obtained from Fusion Scripts for a fee. This fee authorizes you to remove the output of copyright notices: it does not give you authorization to remove any copyright notices in the program source files or any other rights.

MISCELLANEOUS
Fusion Scripts reserves the right to change the terms of this Agreement at any time. Changes to the Agreement will be announced via news bulletin on the Software's web site (http://www.fusionscripts.com). A current copy of this Agreement will be available on the Software's web site (http://www.fusionscripts.com).

TERMS TO PREVAIL
In the event of any inconsistency between the terms of this Agreement and the provisions, acknowledgement or other documentation of the Client, the terms of this Agreement shall prevail.

In the event that this Agreement is translated into any language other than English, then in the resolution of any ambiguity or difference between the English version and such translation the English version will prevail.
